Two Former Cocktail Waitresses Sue Borgata Casino for Sex Discrimination

Two former employees of the Borgata Hotel Casino & Spa in Atlantic City have sued the casino for $70 million, accusing the Borgata supervisors and managers of sex- based discrimination.

The lawsuit, which was filed on Monday, accused the casino of imposing unfair weight limits and standards of beauty on female servers, called "Borgata Babes."

"From the top brass of senior management down to lower-level supervisors, the Borgata's workplace is polluted by rampant sexual stereotypes, a sexual and gender-hostile environment and sex discrimination. Borgata has actually promulgated employment practices by which women are sexually objectified and their workplace performance is secondary to the size of the breasts and waistlines," reads the lawsuit.

Borgata Babes, who wear tight- fitting outfits, are required to maintain hourglass figures and are not permitted to gain more than seven percent of their body weight. Any request for a larger uniform triggers the notification of the woman's superior.

Borgota Babes who gain too much weight are suspended without pay for three months, during which time they are expected to drop the weight with the help of a company- sponsored program. According to the lawsuit, female servers at the Borgata Casino are also encouraged to undergo breast- augmentation surgery. Men, too, are subject to personal appearance rules; they must maintain V- shaped torsos with slim waists and broad shoulders.

The Borgata casino is the only casino in Atlantic City with such a policy, and company officials say that sexy, slim men and women are an important part of the marketing policy at their casino. The Borgata is the most successful casino in Atlantic City.

Renee Gaud, 36, of Mays Landing, and Trisha Hart, 28, of Wenonah, former Borgota cocktail waitresses, seek compensation for humiliation suffered at the hands of managers and supervisors, plus punitive damages and back pay.

Hart was fired after she complained about the weight gain policy. She subsequently suffered from anorexia nervosa. Gaud, who has a thyroid condition that causes fluctuations in her weight, took a leave of absence after she was refused a larger costume.

The women are suing the owners of the casino, Boyd Gaming Corp. and MGM Mirage, Boyd Chairman William S. Boyd, Borgata CEO Robert Boughner and Victor Tiffany, vice president of food and beverage at the casino.

Last year, the women filed sexual discrimination complaints with the New Jersey Division on Civil Rights against the casino. However, they have chosen to pursue the matter in litigation because matters are resolved more quickly in court, and because the potential for monetary compensation exists only in court. The civil rights organization, in contrast, is limited to restating the women and forcing the casino to pay punitive damages.
